Why is there a need for DoLS?
Deprivation of Liberty Safeguards are the amendments made in Mental Capacity Act 2005 in order to protect the rights of those who are deprived or those who are no longer able to make decisions for themselves due to mental disorder. Acid test is used to determine if the person should be deprived of liberty and this includes 2 questions: 1. Is the person free to leave 2. Is the person subject to continuous supervision and control. Need for Deprivation of liberty safeguards: Deprivation of liberty safeguards is needed for the person who lacks the tendency to make decisions for himself or if the person suffers from any mental disorder and needs constant supervision. This decision is made in the best interest of the person so that he or she could receive the necessary care needed. For example a person suffering from Alzheimer's disease may not be able to decide about his care and treatment. Such patients also need constant care and support. In such cases Deprivation of liberty safeguards is needed.
